Are Irrevocable Trusts really “irrevocable?” Today the prevailing professional wisdom seems to be that you can always make the changes your client (whomever that may be) wants to an existing irrevocable trust through trust decanting, trust protectors or judicial modification. This presentation briefly reviews each of those options and focus on several additional solutions to fix an irrevocable trust plan “that has gone bad” when the statutory or common law remedies of decanting and judicial modification won’t achieve the desired results.
